En el conjunto de la historia de la traducción en España, la aportación monacal y de las órdenes religiosas ha tenido una singular importancia. Pero esa actividad, así como la de otros traductores, se revela especialmente interesante en el caso de la Biblia. Un caso concreto, que ofrece quizás el ejemplo más ilustrativo, tanto para descubrir las grandes aportaciones a nuestra cultura de importantes traductores, como la intervención —positiva y negativa— de la Iglesia y de la sociedad en la labor (...) traductora. El recorrido realizado permite sacar algunas conclusiones, que podemos organizar en dos clases: aquellas que se refieren a los hechos históricos estudiados y aquellas que se centran más en la naturaleza de la traducción, y concretamente de la traducción de un texto tan específico y singular como es la Biblia en el mundo occidental. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. The widespread critical evidence surrounding executive compensation of listed corporations has boosted shareholder activism in recent decades. The say-on-pay (SOP) mechanism—a vote in which shareholders express their (dis)agreement with executive pay designs—is one of the corporate governance mechanisms that has led to this activism among listed firms. Merging agency and socioemotional wealth (SEW) arguments, this paper analyzes how effective SOP voting results are among listed family firms in terms of CEO compensation efficiency and equity. Using a sample of UK listed (...) firms from 2011 to 2018, our results show that SOP effectiveness is positively influenced by family ownership and is strongly moderated by family involvement in management and in governance as well as by family generation. Our findings stress the strong family effect and the ethical perceptions of family shareholders on SOP voting, showing how family participation in the firm encourages fairer and more aligned CEO compensation packages. SOP institutional and practical implications oriented to preserve shareholder value and family wealth are finally outlined. (shrink)

Actualmente existe un debate en torno a la naturaleza del sistema nobi a lo largo de la historia de Corea. Podemos encontrar historiadores que definen el sistema nobi como un sistema de esclavitud y a los nobi como esclavos, y a historiadores que prefieren definirlo como un sistema de servidumbre y a los nobi como siervos. En este artículo se expone la interpretación que el historiador estadounidense James B. Palais ofreció sobre el sistema nobi en la dinastía Joseon de Corea (...) a partir de su producción intelectual, poniendo un mayor énfasis en la interpretación ofrecida en su obra Confucian Statecraft and Korean Institutions: Yu Hyongwon and the Late Choson Dynasty, además de exponer las influencias intelectuales que motivaron esta interpretación por parte de Palais. La interpretación de Palais sobre el sistema nobi reviviría el debate en torno a la naturaleza del sistema nobi y sentaría las bases de la interpretación del sistema nobi para los futuros historiadores de Corea. Este artículo está motivado por el problema de la responsabilidad colectiva frente a las acciones cometidas por nuestros antepasados y por la pregunta acerca de la legitimidad de las demandas de perdón. Acudiendo al universo conceptual heredado de Hannah Arendt, en este texto se aboga por el ejercicio de la capacidad de juicio como detonante tanto de la demanda de perdón como de la responsabilidad colectiva. El perdón se presenta así no solo como una categoría moral sino fundamentalmente política, imprescindible (...) para reconciliarse con lo acontecido y mirar al futuro con esperanza. (shrink)

El trabajo llama la atención sobre un problema poco atendido por los filósofos contractualistas el cual puede presentarse a manera de pregunta: ¿Cuál es la posición original de los individuos que pactan un acuerdo de fundación de la sociedad civilizada? Para efectos del presente trabajo recurriré a la propuesta de contrato social en De Cive (1642) y Leviathan de Thomas Hobbes (1651). El trabajo defenderá la tesis de que el camino sugerido por Hobbes apela a un recurso que, a pesar (...) de ser presentado como de vital importancia en su teoría contractual, resulta inútil. Tal recurso es el que se refiere al pacto de sociedad. A pesar de que este paso fundamenta la vida civilizada finalmente es abandonado por el autor teniendo que recurrir a la fuerza coactiva del soberano para hacer cumplir lo prometido en el pacto. La razón es que los seres humanos son egoístas y tienden ineludiblemente a ser bribones: la fuerza coactiva del soberano tiene que corregir tales comportamientos. La conclusión que alcanzo a vislumbrar es que la mesa de negociación en la posición inicial sólo podría estar conformada por algunos individuos cautos, y, muchos bribones y tontos. Este conjunto de individuos con diferente percepción del significado del interés social justificaría el gran peso del argumento de la coacción gubernamental posterior al pacto de sociedad hobbesiano. Los argumentos tradicionales contrarios a la disponibilidad de la propia vida conservan alguna fuerza: en algunas sociedades, el intento de suicidio se considera todavía un delito y la colaboración —o complicidad— sigue siendo igualmente una conducta delictiva. No obstante, en los últimos años se ha llevado a cabo un creciente reconocimiento del llamado “derecho a una muerte digna”. De todos modos, ese derecho soporta ciertas condiciones que lo convierten, a mi entender, más en un eslogan pegadizo y engañoso que en (...) un derecho claramente consolidado y reconocido. En el presente artículo intentaré explicar diversos argumentos a favor y en contra de la libre disponibilidad de la propia vida formulados a lo largo de la historia del pensamiento occidental. Posteriormente, trataré de demostrar que la libre disposición de la propia vida encuentra demasiadas restricciones en España y que en algunas de ellas subyacen principios extraseculares impropios de una sociedad democrática, pluricultural y secular como la nuestra. Integrated Information Theory stands out as one of the most promising theories for dealing with the hard problem of consciousness. Founded on five axioms derived from phenomenology, IIT seeks for the physical substrate of consciousness that complies with such axioms according to the criterion of maximally integrated information. Eventually, IIT identifies phenomenal consciousness with maximal Φ or, what is the same thing, with the strongest cause-effect power in the system. Among the scholars critical of this theory, some point to the (...) so-called Intrinsicality Problem, namely that consciousness cannot be an intrinsic property of the system because maximal Φ crucially depends on the possible existence of bigger values of Φ if the initial system is appropriately linked to or embedded in larger systems. Although proposals in the recent literature aim to solve the IP by going beyond reductionism and physicalism, none of them tackle the real issue, i.e., the insufficiency of IIT’s causal-metaphysical structure. This papers endeavors to provide a solution to the IP in IIT within a hylomorphist ontology that includes formal causation. Complementing IIT with formal causation provides the theory with a criterion of individuation that solves the IP and, by relaxing identification between maximal Φ and consciousness, it lends a more robust metaphysical structure. To wit, maximal Φ is a necessary but not sufficient condition for the existence of consciousness. (shrink)

The standard view in current philosophy of creativity says that being creative has two requirements: being novel and being valuable. The standard view on creativity has recently become an object of critical scrutiny. Hills and Bird have specifically proposed to remove the value requirement from the definition, as it is not clear that creative objects are necessarily valuable or creative people necessarily praiseworthy. In this paper, I argue against Hills and Bird, since eliminating the element of value from the explanation (...) of creativity hinders the understanding of the role that creative products play in actual epistemic practices, which are fundamentally normative. More specifically, I argue that the terms ‘creativity’ and ‘creative’ function as thick epistemic concepts when employed by competent epistemic agents in practice, that is, these concepts have both a descriptive and an evaluative content that cannot be disentangled from one another. Accordingly, I suggest that philosophers should prefer thick accounts over thin accounts of creativity. A thick account of creativity is one that endorses the standard view at its basis, but further develops it in two ways: by stressing the entanglement of the value and novelty requirements; by permitting to encompass a range of domain-specific characterizations of such entanglement for different epistemic situations. In order to take the first steps in the development of such a thick account of creativity, I look at the domain of scientific practices as a case in point, and try to spell out what the thickness of creative instances typically entails here. Namely, I identify the worthy novelty of creative models and methods with their potential to clarify a tradition, with fruitfulness, and with the fulfilment of exploratory aims. (shrink)

It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. I end by outlining some challenges for the humean world-view that results after this shift. (shrink)

BackgroundMonitoring recovery–stress balance in sport is becoming more relevant to prevent training maladaptation and reach the optimal performance for each athlete. The use of questionnaires that identify the athlete’s recovery–stress state have much acceptance in sports due to reliability and useful, furthermore for its low cost. Identifying possible differences between sport modalities and sex is important to determine specific needs and possible intervention ways to keep a recovery–stress balance. The aim was to analyze the differences in the recovery–stress state and (...) mood states by sex and sport type during the competitive phase in young Mexican athletes. As a secondary objective, the psychometric properties of the Mexican version of the Recovery–Stress Questionnaire for Athletes were analyzed.MethodsA cross-sectional study was carried on with 461 athletes, 17.95 years old, from six sports disciplines. The RESTQ-Sport and Profile of Mood States were applied in a single moment. Differences by sex and sports modality were analyzed. RESTQ-Sport’s confirmatory factor analysis was performed after the stress and recovery theoretical structure of two stress and two recovery dimensions, and last, the concurrent validation with the POMS was carried on.ResultsSignificant differences by sex were found in the General Recovery and Sport Stress dimensions of the RESTQ-Sport as well as Vigor factor of the POMS, being higher for men; furthermore, both the Sport Recovery dimension of RESTQ-Sport and Cholera and the Fatigue and Depression factors from POMS also had differences by sport type, showing a less recovery and high stress for individual sport athletes. Goodness-of-fit indexes of the model for the RESTQ-Sport were acceptable. Pearson’s correlation between questionnaires was moderate.ConclusionThe recovery–stress state shows differences in the function of sex and sport modality. More special attention is suggested for women and individual sport athletes. The higher punctuation for men compared with women in sport stress dimension did not negatively affect the recovery–stress balance for male athletes. Finally, the Mexican context adaptation of the RESTQ-Sport provides a psychometric instrument suitable to assess the recovery–stress balance in Mexican athletes. (shrink)

This paper describes the Eunomos software, an advanced legal document and knowledge management system, based on legislative XML and ontologies. We describe the challenges of legal research in an increasingly complex, multi-level and multi-lingual world and how the Eunomos software helps users cut through the information overload to get the legal information they need in an organized and structured way and keep track of the state of the relevant law on any given topic. Using NLP tools to semi-automate the lower-skill (...) tasks makes this ambitious project a realistic commercial prospect as it helps keep costs down while at the same time allowing greater coverage. We describe the core system from workflow and technical perspectives, and discuss applications of the system for various user groups. (shrink)

This work begins with a brief review – from the _physical education_ movement that began in ancient Greece and is deeply rooted in 19th century Europe, to the _somatics_ movement alive today. The review captures primary historical and conceptual references, relevant to the therapeutic-embodied exploratory work. Then, G. Stanghellini’s mental health care model [ 2 ] is reviewed. This model is considered within reflexive self-awareness and spoken dialogue: the main vehicles in relation with alterity and its consequences in the realm (...) of psychotherapeutic encounter and intervention. This will highlight the individual’s bodily movement and inter-corporeal ‘proto-dialogue’ as a prior realm of therapeutic intervention. Next, a brief consideration of E. Strauss work [ 31 ] is presented. This paper’s hypothesis is that bodily qualitative dynamics highlighted by phenomenology are essential for an effective mental health therapeutic intervention. A ‘seed’ of a framework is proposed in this paper; this seed assesses some phenomenological assets of a positive conception of mental health, for which self-awareness education is key to develop skills such as _kinaesthetic intelligence_ and _attunement_ and to educate healthy persons who can promote edifying social relations and environments. The Maximum Entropy Production Principle (MEPP) stands out as an overarching principle that rules life phenomena in Nature. However, its explanatory power beyond heuristics remains controversial. On the one hand, the MEPP has been successfully applied principally to non-living systems far from thermodynamic equilibrium. On the other hand, the underlying assumptions to lay the MEPP’s theoretical foundations and range of applicability increase the possibilities of conflicting interpretations. More interestingly, from a metaphysical stance, the MEPP’s philosophical status is hotly debated: does (...) the MEPP passively translate physical information into macroscopic predictions or actively select the physical solution in multistable systems, granting the connection between scientific models and reality? This paper deals directly with this dilemma by discussing natural determination from three angles: (1) Heuristics help natural philosophers to build an ontology. (2) The MEPP’s ontological status may stem from its selection of new forms of causation beyond physicalism. (3) The MEPP’s ontology ultimately depends on the much-discussed question of the ontology of probabilities in an information-theoretic approach and the ontology of macrostates according to the Boltzmannian definition of entropy. Parent and preschool teacher ratings of the 10 noun categories of MacArthur-Bates Communication Development Inventory were used to study expressive language in 2–4-year-old children with autism spectrum disorder across the home and preschool context. There was no significant difference in the total number of words the children said in the two contexts, but the children said significantly more words in the noun categories “Furniture and rooms” and “People” at home. Only one third of the words the children said were said (...) both at home and in the preschool, while the other two thirds were said only at home or only in preschool. This suggests that what words the children use across contexts differ substantially and that their vocabulary is larger than it seems when measured only in one context. This novel study highlights the importance of assessing the language in children with ASD in multiple contexts in order to better measure their vocabulary and to design appropriate language interventions.
